Terms and Conditions

1. Seller and scope

These Terms and Conditions apply to contracts with consumers for new and pre-owned collectibles purchased through this online shop. Different terms form part of the contract only if Collectamie expressly agrees to them.

2. Orders and formation of the contract

A product listing is an invitation to place an order and is not yet a binding offer. You may place products in the basket and correct your entries using the edit and back functions provided until you submit the order.

By activating the button clearly marked as creating an obligation to pay, you make a binding offer to buy the products shown in the order overview. A contract is formed when Collectamie accepts that offer in an express order-confirmation email. A purely technical acknowledgement is not acceptance unless it is expressly identified as the order confirmation.

The order data, these Terms and the withdrawal information are provided with the order confirmation on a durable medium. If you have an account, the principal order data also remain available there. Contracts may be concluded in German, English or French.

3. Products and condition information

Many collectibles are pre-owned or available only once. The essential characteristics and disclosed condition details, signs of use, additions and special features in the product description form part of the agreed characteristics.

Colours and measurements may differ slightly where this is technically unavoidable in display or measurement. Condition descriptions and images do not restrict statutory rights where goods do not conform to the contract. Availability remains subject to contract formation.

4. Prices and payment

All prices shown are total prices in euros. Collectamie currently uses the Austrian small-business VAT exemption under section 6(1)(27) UStG, so Austrian VAT is not shown separately. Where destination-country VAT is mandatory, it is included in the total price shown.

Additional delivery charges are shown separately before the order is submitted. The payment methods offered at checkout apply. Payments are processed by Stripe and the terms of the selected payment service also apply. The purchase price is due when the contract is formed unless checkout states otherwise.

5. Delivery

Delivery is available to the destinations selectable at checkout in Austria, Germany and France. Available methods, the carrier and the actual charges are shown before the order is submitted.

Unless a different period is stated on the product or at checkout, delivery takes up to 14 days from contract formation; where advance payment is agreed, the period begins when payment is received. Mandatory rights in the event of delay remain unaffected.

For consumer purchases, risk of accidental loss or damage passes only when the goods are handed to you or to a person designated by you who is not the carrier.

6. Withdrawal and returns

Consumers generally have a fourteen-day right of withdrawal. The conditions, time limits, direct return costs, reimbursement and optional model form are set out in the separate withdrawal information.

Withdrawal may be declared by email, by post or through the continuously accessible online function labelled “Withdraw from contract”. A statutory exception applies only where its requirements are met and any product-specific exception will be explained clearly before ordering.

7. Statutory conformity rights and liability

Goods are covered by statutory conformity rights and their mandatory remedies, generally for a minimum of two years. These rights also apply to pre-owned goods; these Terms do not agree a shorter period. A separate commercial guarantee exists only if it is expressly promised for a product.

For pre-owned or one-off collectibles, condition features specifically disclosed before contract formation form part of the agreed characteristics. This does not restrict statutory rights. Statutory rules apply to damages and all other liability.

8. Complaints, governing law and disputes

Complaints may be sent to support@collectamie.com or to the postal address above. Collectamie will seek a prompt direct resolution.

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice does not deprive consumers of mandatory protection under the law of their country of habitual residence. Statutory jurisdiction rules apply.

Collectamie has not voluntarily committed to a particular consumer arbitration body. If a complaint cannot be resolved directly, Collectamie will inform the person concerned on a durable medium of the competent Austrian alternative-dispute-resolution body and whether Collectamie will participate. The former EU Online Dispute Resolution platform is no longer operated.
